Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the Nails POS software, website, and services operated by Nails POS.

By accessing or using our service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the service.

1. Subscription and Account Terms

  • You must be 18 years or older to use this service.
  • You must provide accurate, current, and complete information during the registration process.
  • You are responsible for safeguarding the password and for all activities that occur under your account.
  • You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
  • Your subscription begins when your initial payment is processed.
  • Subscription fees are billed in advance on a monthly or annual basis.
  • There are no refunds for partial months of service or for unused time with an active account.

2. Free Trial

We may offer a free trial of our service. The trial period lasts for 30 days, or as otherwise specified during sign-up.

At the end of the trial period, your account will automatically be charged for a subscription unless you cancel before the trial ends. You may be required to enter your billing information to start a trial.

3. Acceptable Use

You agree not to use the service for any purpose that is unlawful or prohibited by these Terms. You may not:

  • Use the service in any manner that could damage, disable, overburden, or impair Nails POS systems
  • Attempt to gain unauthorized access to any part of the service, other accounts, or computer systems
  • Use the service to transmit any computer viruses, malware, or harmful code
  • Attempt to decompile, reverse engineer, or disassemble the software
  • Use the service to collect or harvest personal information about other users
  • Engage in any activity that interferes with or disrupts the service

4. Service Modifications

Nails POS reserves the right to modify or discontinue, temporarily or permanently, the service (or any part thereof) with or without notice. We shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the service.

5. Payment and Billing

Payment for subscriptions must be made in advance. If payment is not received, we reserve the right to terminate your access to the service.

Prices are subject to change upon 30 days' notice. Such notice may be provided by email or by posting the changes on the Nails POS website.

You are responsible for all taxes (excluding taxes on our net income), and we will charge tax when required to do so.

6. Cancellation and Termination

You may cancel your subscription at any time through your account settings or by contacting our customer support team. Upon cancellation, your subscription will remain active until the end of your current billing period.

Nails POS may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms of Service. Upon termination, your right to use the service will immediately cease.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

7. Data Security and Privacy

Your use of the service is also governed by our Privacy Policy, which can be found here.

We take reasonable precautions to protect your information. However, we cannot guarantee that your information will not be intercepted while transmitted to us. We are not liable for unauthorized access to your data.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

NAILS POS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED. NAILS POS DOES NOT WARRANT THAT THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE.

9. Limitation of Liability

IN NO EVENT SHALL NAILS POS, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

10. Indemnification

You agree to defend, indemnify, and hold harmless Nails POS and its licensors, service providers, and their respective officers, directors, employees, contractors, agents, licensors, suppliers, and successors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms of Service or your use of the Service.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the service.
